Terms of Service

1. Definitions

In these Terms of Service ("Terms"):

• "Service" refers to the WPimg image optimization and CDN service, including the Plugin and the CDN API.
• "Plugin" refers to the WPimg WordPress plugin software.
• "CDN" or "CDN Service" refers to our proprietary image optimization and content delivery network accessible via wpimg.io.
• "We," "Us," "Our" refers to Trimbit Ltd, a limited company registered in Finland.
• "You," "Your," "Customer" refers to the individual or entity using the Service.
• "Subscription" refers to your paid access to the CDN Service.

2. Hybrid License

The Service consists of two distinct components with separate licensing:

2.1 Plugin License (Open Source)

The WPimg WordPress Plugin is free and open-source software licensed under the GNU General Public License version 2 or later (GPL v2+). You may:

• Use, copy, modify, and distribute the Plugin
• Create derivative works based on the Plugin
• Use the Plugin for any purpose

2.2 CDN Service License (Proprietary)

The CDN Service, including the image optimization API, infrastructure, and all related backend systems, is proprietary software. A free tier is available with usage limits; paid subscriptions provide higher limits. The CDN Service:

• Is available via the free tier or paid subscription
• May not be reverse-engineered, decompiled, or circumvented
• May not be resold, sublicensed, or shared without written permission
• Is accessed only through the domain where the Plugin is installed

The Plugin without the CDN Service will not optimize images. The Plugin is designed to work exclusively with our CDN Service.

3. Service Description

WPimg provides automatic image optimization for WordPress websites. The service works by:

1. Using output buffering in WordPress to intercept image URLs in your HTML
2. Rewriting those URLs to point to our CDN (wpimg.io)
3. Optimizing and converting images on-the-fly (WebP, AVIF)
4. Serving optimized images from our global CDN

Important: Your original images remain unchanged on your server. We proxy and optimize them on-the-fly; we do not modify your original files.

4. Acceptable Use & Fair Use

You agree to use the Service in good faith and in accordance with this acceptable use policy.

4.1 Permitted Use

• Optimizing images on WordPress websites you own or manage
• Using the Service for the domain where the Plugin is installed
• Normal traffic patterns consistent with legitimate website usage

4.2 Prohibited Conduct

The following activities are strictly prohibited and may result in immediate service termination:

Cache Busting

Systematically varying URL parameters, query strings, or other mechanisms to force re-processing of the same image. This includes but is not limited to:

• Adding random query parameters to bypass caching
• Programmatically generating unique URLs for identical images
• Any technique designed to artificially inflate processing requests

Hotlinking

Using optimized CDN URLs on domains other than where the Plugin is installed. The Service is valid only for the domain where the Plugin is actively running.

Abuse & Overload

• Attempting to overload, disrupt, or damage our infrastructure
• Reselling access to the CDN Service without authorization
• Using automated tools to scrape or harvest optimized images

Prohibited Content

You represent and warrant that all images processed through the Service:

• You own or have the legal right to use, including all necessary copyrights, licenses, and permissions
• Do not infringe any third-party intellectual property rights
• Do not contain child sexual abuse material (CSAM) or any sexualized content involving minors
• Do not contain content illegal under Finnish law, EU regulations, or the laws of your jurisdiction
• Do not promote terrorism, violence, or hate speech

Zero-Tolerance Policy: We have a zero-tolerance policy for CSAM. Sites found processing such content will be immediately blocked, reported to relevant authorities (including NCMEC and Finnish police), and we will fully cooperate with law enforcement investigations.

4.3 Enforcement

We reserve the right to:

• Monitor usage patterns for abuse detection
• Throttle or rate-limit sites exhibiting abnormal usage
• Suspend or terminate access for sites that threaten infrastructure stability
• Take any action necessary to protect the Service and other users

5. Free Tier

5.1 Free Tier Availability

We offer a free tier of the CDN Service that allows you to use the Service within specified usage limits at no cost. No payment method is required to use the free tier.

5.2 Free Tier Limits

The free tier is subject to usage limits, which may include restrictions on the number of images optimized, bandwidth usage, or other service parameters. Current limits are displayed in the Plugin settings and on our pricing page. We reserve the right to modify free tier limits at any time.

5.3 Exceeding Free Tier Limits

When you reach your free tier limits:

• New images will be served unoptimized
• Previously optimized images may continue to be served from cache
• You can upgrade to a paid plan at any time to restore optimization

5.4 Free Tier Restrictions

• The free tier is for legitimate use only
• Circumventing usage limits through technical means or multiple installations is prohibited
• The free tier is subject to the same Acceptable Use Policy as paid subscriptions (see Section 4)
• We reserve the right to modify, suspend, or discontinue the free tier at any time

6. Refunds & Money-Back Guarantee

6.1 Merchant of Record

All payments are processed by Lemon Squeezy, our merchant of record. Lemon Squeezy handles payment processing, billing, sales tax, and related financial matters. By purchasing, you also agree to Lemon Squeezy's Buyer Terms.

6.2 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee for new subscriptions, subject to the following conditions:

• The refund request must be made within 14 days of your first paid billing date
• Refunds apply only to first-time purchases, not renewals or upgrades
• To request a refund, contact us at [email protected]

6.3 Usage Threshold

To prevent abuse, the money-back guarantee is only valid if your account has not exceeded:

• 5 GB of bandwidth, OR
• 2,000 image optimization requests

If you exceed either threshold within the 14-day period, you are not eligible for a refund. This policy exists to prevent "pump and dump" abuse where the Service is used extensively and then refunded.

6.4 Subscription Renewals

Subscriptions renew automatically. There are no refunds for unused subscription periods after the initial 14-day window. You may cancel at any time to prevent future renewals.

6.5 Chargebacks

Please contact us before initiating a chargeback with your bank. Unwarranted chargebacks may result in account termination and collection of liquidated damages as per Lemon Squeezy's terms.

7. Termination & Cancellation

7.1 Cancellation by You

You may cancel your subscription at any time through your account dashboard or by contacting support. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• No further charges will be made after cancellation
• There are no refunds for unused time in the current period

7.2 Effect of Cancellation or Expiration

When your subscription ends (whether by cancellation, expiration, or termination):

• Image optimization stops immediately
• Images will no longer be served through our CDN
• The Plugin will remain installed but non-functional for optimization

7.3 Grace Period (SEO Consideration)

To help preserve your SEO, we may provide a grace period of up to 30 days after subscription end during which:

• Requests to wpimg.io URLs may return 301 redirects to your original image URLs
• This helps search engines re-index your original image URLs

Important: This grace period is provided as a courtesy and is not guaranteed. After the grace period (or immediately if no grace period is provided), requests will return 4xx error codes (such as 404 Not Found or 410 Gone).

7.4 SEO Disclaimer

WE EXPLICITLY DISCLAIM ANY LIABILITY FOR:
Google Images or other search engines may take weeks or months to re-crawl and re-index your original image URLs. We have no control over third-party indexing schedules. Any temporary or permanent changes in search rankings, image visibility, or traffic resulting from cancellation, termination, or service interruption are entirely your responsibility.

7.5 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

• You violate these Terms, including the Acceptable Use Policy
• Your usage threatens infrastructure stability
• We are required to do so by law
• Payment fails and is not resolved within a reasonable period

10. Indemnification

You agree to indemnify, defend, and hold harmless Trimbit Ltd, its directors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content on your website
• Any disputes with your website visitors or customers

11. Service Availability

11.1 No Uptime Guarantee

While we strive for high availability, we do not guarantee 100% uptime. The Service may be unavailable due to:

• Scheduled or unscheduled maintenance
• Infrastructure issues at our hosting providers
• Network connectivity problems
• Force majeure events
• DDoS attacks or security incidents

11.2 Client-Side Fallback

The Plugin includes a client-side JavaScript fallback mechanism that attempts to display original images if our CDN is unreachable. However:

• This fallback is provided as a best-effort feature
• It may not work in all browsers or situations
• It does not guarantee uninterrupted image display
• We are not liable for any issues arising from fallback functionality

11.3 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

12. Privacy & Data

By using the Service, you acknowledge that:

• We process image URLs and related metadata to provide the Service
• Images are cached on our CDN infrastructure
• We may collect basic analytics and usage data
• We do not access, store, or process personal data from your website visitors beyond what is technically necessary to serve images

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

For material changes that significantly affect your rights, we will make reasonable efforts to notify you via email or through the Service.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Finland. You agree to submit to the personal jurisdiction of such courts.

For EU consumers: Nothing in these Terms affects your statutory rights under applicable EU consumer protection laws.
